Common Questions
Questions people often ask us
What happens to assets in Thailand when someone passes away?
In Thailand, estate assets are distributed according to a valid will if one exists, or under the Civil and Commercial Code provisions on statutory heirs if there is no will. The process typically involves a court administrator being appointed, debts being settled, and the remaining estate distributed to the beneficiaries. We can walk you through how this applies to your particular situation.
Can a foreign national inherit or own property in Thailand?
Foreign nationals face certain restrictions on land ownership in Thailand, though condominiums and some other property types can be held directly. Inheritance by foreign beneficiaries is possible but must be handled carefully within Thai law. We have experience advising on mixed-nationality estates and can explain clearly what is and is not possible in your circumstances.
How long does probate or estate administration typically take?
The timeline varies considerably depending on the complexity of the estate, whether there is a valid will, and whether all interested parties are in agreement. A straightforward matter with a clear will might be resolved in a few months; more complex or contested situations take longer. We will give you a realistic picture of timelines at the outset and keep you informed throughout.
Do I need a Thai will if I already have a will in my home country?
A Thai will is generally advisable if you hold assets in Thailand, as it simplifies the administration process considerably. While foreign wills can sometimes be recognised, the process is more complex and time-consuming. A brief consultation is the easiest way to assess whether a separate Thai will would be beneficial for your situation.
What if family members disagree about the estate?
Disagreements within families over estates are more common than people expect, and they do not always require formal dispute proceedings. Sometimes a clear, patient explanation of the legal position helps all parties reach an understanding. Where formal steps are needed, we provide full representation and keep you informed of every decision along the way.
How much does it cost and how is the fee structured?
Our three service options are priced at ฿7,200 for an initial consultation, ฿11,000 for probate and administration support, and ฿13,800 for full representation. All fees are discussed and agreed before any work begins. There are no hidden costs, and if the scope of work changes, we discuss that with you before proceeding.
